Construction Defect Litigation

In an effort to reduce litigation, the Florida Legislature enacted Chapter 558 of the Florida Statutes, governing disputes over construction defects. Currently, the statute is limited to disputes concerning residential property. However, the Florida Legislature amended Chapter 558 to apply to construction disputes related to any real property other than public transportation projects. These amendments become effective on October 1, 2006. Understanding the dispute resolution process set forth in the statute, as well as, knowing when Chapter 558 applies to your particular project will be essential to preserving your rights in a dispute.
 
Construction defects, as defined by Chapter 558, cover a broad range of issues. Examples include deficiencies in the design, specifications, surveying, planning, supervision, use of defective materials, or failure to perform within the accepted standard of care or professionalism for the trade or profession. It appears an argument can be made that the provisions contained in Chapter 558 will be applicable to virtually all disputes arising during construction.

The statute contains important requirements you must follow before you may bring any legal action for an alleged construction defect in your home. Sixty days before you bring any legal action, you must deliver to the other party to this contract a written notice referring to chapter 558 of any construction conditions you allege are defective and provide such person the opportunity to inspect the alleged construction defect and to consider making an offer to repair or pay for the alleged construction defects. You are not obligated to accept any offer which may be made. There are strict deadlines and procedures under this Florida law which must be met and followed to protect your interests.
